Terms of Service
Effective date: 12 August 2025
These Terms govern access to and use of PBX/VoIP services, number porting, and hardware supplied by Voipshop (Pty) Ltd ("we"). By ordering or using our services you agree to these Terms.
1. Accounts & eligibility
- You must provide accurate company and contact information and keep it up to date.
- You are responsible for safeguarding credentials and all activity on your account.
2. Orders, pricing & billing
- Prices are in South African Rand and may change; we will notify you of material changes in advance.
- Recurring service fees are billed monthly in advance; usage (e.g., call charges) is billed in arrears where applicable.
- We may suspend service for non‑payment after reasonable notice.
3. Services
- Services include hosted PBX features, SIP trunks, call routing, and related support.
- Service levels are described in our SLA. We will use reasonable skill and care to provide the services.
- Service availability may be affected by third‑party networks, power, and internet connectivity.
4. Installation, onsite work & support
- Standard support is provided remotely via our service desk and WhatsApp channel.
- Onsite work, moves/adds/changes, cabling, repairs, and training are billed at a call‑out fee of R450 plus parts and travel where applicable.
5. Hardware
- Hardware carries a manufacturer or supplier warranty of 3 years against defects under normal use.
- Risk in hardware transfers on delivery. Title transfers on full payment.
6. Number porting
- Porting requires valid documentation from you and acceptance by your current provider. Timelines are controlled by the portability administrator and incumbent provider.
- Porting fees are non‑refundable once submitted.
7. Acceptable use
- No illegal, abusive, fraudulent, nuisance, or bulk unsolicited calling. Do not attempt toll fraud or compromise our systems.
- We may suspend or terminate services for material breach or to protect the network.
8. Data protection
We process personal information in accordance with our Privacy Policy and POPIA.
9. Warranties & disclaimers
Except as expressly stated, services are provided "as is" and "as available". We do not warrant uninterrupted or error‑free operation.
10. Liability
To the fullest extent permitted by law, neither party is liable for indirect or consequential losses. Our aggregate liability for all claims arising in a 12‑month period is limited to the fees paid by you to us for the services giving rise to the claim in that period. Nothing limits liability for death or personal injury caused by negligence, fraud, or liability that cannot be excluded by law.
11. Term & termination
- Services are generally month‑to‑month unless a different term is agreed in writing.
- You may cancel on at least one full billing cycle’s notice. Fees already due/paid are non‑refundable unless required by law.
- We may terminate for material breach (including non‑payment) after notice and an opportunity to remedy where reasonable.
12. Changes
We may update these Terms; material changes will be communicated with reasonable notice. Continued use after the effective date constitutes acceptance.
13. Governing law
These Terms are governed by the laws of the Republic of South Africa. Disputes are subject to the non‑exclusive jurisdiction of South African courts.
